Nutrition Consultation and Terms and Conditions

General Information

These Terms and Conditions govern the relationship between the client (referred to as “you” or “the client”) Grounded Clinical Nutrition (referred to as “we”, “us”, or “the provider”), in relation to the provision of nutrition consultation services.

By booking and attending a consultation, you agree to these terms.

Scope of Services

Our nutrition consultations include:

  • Nutritional assessment and advice

  • Meal planning and dietary guidance

  • Support for general wellness, weight management, and certain health conditions (as appropriate)

  • Advise on nutrition supplementation where necessary

Please note: We do not diagnose or treat medical conditions. Nutritional advice is not a substitute for professional medical advice, diagnosis, or treatment.

Client Responsibilities

You agree to:

  • Provide accurate and complete information about your health and lifestyle

  • Inform us of any medical conditions, medications, or treatments

  • Follow advice and recommendations responsibly and consult your healthcare provider when necessary

Confidentiality

All personal and health information you provide will be kept confidential in accordance with relevant data protection laws, Privacy Act 1998. We will not share your information without your consent unless required by law.

While we try our best to fulfil all Booking Requests and Bookings, you agree that we have the right to accept, reject or cancel a Booking Request or Bookings for any reason at any time, and all Booking Requests are subject to availability. If we cancel a Booking which has been paid for but not yet delivered, we will provide a full/partial refund of all monies paid in relation to the cancelled Booking.

 

Payments and Fees

  • Fees for consultations are due at the time of booking or as otherwise agreed

  • Accepted payment method: credit/debit card upon booking

  • A receipt or invoice will be provided upon request

  • In the event that any payment under these Terms and Conditions is not made in full on the due date, Grounded Clinical Nutrition is entitled to charge You interest at the rate of 5% per annum, calculated daily.

  • You agree that if You default on any payments due and payable under these Terms and Conditions, any costs incurred by Grounded Clinical Nutrition for steps taken to enforce payment Terms and Conditions will be recoverable and payable by You.

  • You acknowledge and agree that Grounded Clinical Nutrition is not responsible for any third-party payment processing fees, bank fees, transaction fees, currency conversion fees and/or adverse currency fluctuations.

  • If applicable, unless otherwise stated, all amounts are listed in Australian Dollars (AUD) and are GST exclusive, being goods and services tax as defined in A New Tax System (Goods and Services Tax) Act 1999, exclusive amounts. Where the Services are provided outside Australia, GST is inapplicable.

Sales and Promotions

  • We may offer sales and discount codes (each a Promotion) from time to time, and you agree that:

  • Promotions apply to full priced items only;

  • Only one discount code can be used in connection with an Booking;

  • Discount codes cannot be used in conjunction with any other offer;

  • Discount codes are not transferable;

  • Discount codes must be used by the date specified (where applicable);

  • Promotions cannot apply retrospectively to previous Bookings; and

  • We may change or cancel any Promotion at any time and at any time by giving you notice by email, conventional mail or by posting it on our website, within our sole discretion.

AI Tools

  • I understand that AI-powered tools may be used to assist in analysing dietary patterns, generating meal suggestions, and tracking nutritional progress. These tools are supervised by a qualified nutrition professional, and final recommendations are based on human judgment.

  • If I do not wish for them to be used, I will inform the practitioner, prior to the consultation.

Cancellations and Refunds

  • At least 48 hours’ notice is required for cancellations or rescheduling

  • Late cancellations or no-shows may incur a fee or loss of deposit

  • Refunds are issued at our discretion and are not guaranteed

Limitation of Liability

We are not liable for any loss, injury, or damage arising from your reliance on nutritional advice. You accept full responsibility for your health decisions and outcomes.

Dispute Resolution

  • If a dispute arises out of or relates to these Terms and Conditions, either party may not commence any legal proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).

  •  A party to these Terms and Conditions claiming a dispute (the Dispute) has arisen under these Terms and Conditions, must give written notice to the other party detailing the nature of the Dispute, the desired outcome and the action required to settle the Dispute

·       On receipt of the Dispute by the other party, the parties must within 7 days from the date the Notice was served, attempt in good faith to resolve the Dispute as expeditiously as possible, including by negotiation or such other means upon which they may mutually agree.

Use of Website: Restricted Use

When using our Website or Services, you are responsible for your use and for any use of our Website or Services made using your device. You also agree that your use of our Website or Services is for personal non-commercial use. You agree not to access, copy, or otherwise use our Website or Services, including our intellectual property and trademarks, except as authorised by these Terms and Conditions of Use or as otherwise authorised in writing by us.  Unless we agree otherwise in writing, you are provided with access to our Website only for your personal use. You may not without our written permission on-sell information obtained from our Website.

You agree:

  • You will not copy, distribute or disclose any part of the Website or the Service in any medium, including without limitation by any automated or non-automated “scraping”;

  • You will not attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Website or Service;

  • You will not take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure;

  • You will not collect or harvest any personally identifiable information, including account names, from the Service;

  • You will not stalk, harass, bully or harm another individual who uses our Website or Service;

  • You will not upload, post, transmit or otherwise make available any material that:

    • is not your original work, or which may infringe the intellectual property or other rights of another person;

    • is, or could reasonably be expected to be, defamatory, obscene, offensive, threatening, abusive, pornographic, vulgar, profane, indecent or otherwise unlawful, including material that racially or religiously vilifies, incites violence or hatred, or is likely to offend, insult or humiliate others based on race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability;

    • includes an image or personal information of another person unless you have their consent;

    • you know or suspect, or should reasonably know or suspect, to be false, misleading or deceptive;

    • contains large amounts of untargeted, unwanted or repetitive content; or

    • contains financial, legal, medical or other professional advice.

  • You will not impersonate any person or entity or misrepresent your affiliation with a person or entity;

  • You will not hold Grounded Clinical Nutrition responsible for your use of our Website;

  • You will not violate any requirements, procedures, policies or regulations of networks connected to Grounded Clinical Nutrition.

  • You will not interfere with or disrupt the Website or Service;

  • You will not hack, spam or phish us or other users;

  • You will provide truthful and accurate content;

  • You will not violate any law or regulation and you are responsible for such violations;

  • You will not use our Website to post any false, misleading, unlawful, defamatory, obscene, invasive, threatening, harassing, inflammatory, fraudulent content;

  • You will not cause, or aid in, the destruction, manipulation, removal, disabling, or impairment of any portion of our Website, including the de-indexing or de-caching of any portion of our Website from a thirty party’s website, such as by requesting its removal from a search engine; and

  • You will not upload any content to our Website that includes any third party intellectual property unless you have permission from the owner to use it in the specific manner that you used it.

  • We reserve the right to refuse service, block or suspend any user of the website, and to modify or remove any material uploaded, posted, transmitted or otherwise made available on the website by any user, without prior notice.

  • We are not responsible for, and accept no liability with respect to, any material uploaded, posted, transmitted or otherwise made available on the website by any person other than us. We do not endorse any opinion, advice or statement made by any person other than us.

  • You agree to indemnify us and each of our officers, employees, agents, contractors, suppliers and licensors (collectively, Affiliates) in respect of any liability, loss or damages (including all legal and other costs on a full indemnity basis) suffered or incurred by them arising (in whole or part) out of the breach of or failure to comply with any of these Terms and Conditions of Use, or any other default or wrongful conduct in relation to the subject matter of these Terms and Conditions of Use, on the part of you or any of your Affiliates.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Updated terms will be made available on our website or upon request.
